The terms

In short
- Sam reads your photo and question and replies to you by email. It is free, and there is no obligation to buy anything.
- Your photo is checked automatically by Google’s Gemini service, then goes to Sam by email. It is never sold, and never sent to our customer database.
- We only publish your photo if you choose that below, separately from accepting these terms. You can change your mind at any time and we will take it down.
- Photos of anyone under 18 are never published, whatever is chosen.
- Only send a photo of yourself, or one you have permission to send from everyone in it.
1. Who we are
“Ask Sam” is a free style critique offered by Sam's Menswear, a custom tailor at 318 Charlton Avenue, Vaughan, Ontario L4J 6H4 (“Sam's Menswear”, “we”, “us”). In these terms, “you” means the person sending the submission, and “your submission” means the photo, your question, the occasion, your name or initials and your email address.

2. What the service is, and what it is not
Sam looks at the photo you send and replies by email with his opinion: what is working, the one change he would make, and how to make it. It is one tailor's opinion about clothes, given in good faith. It is not a guarantee of any result, and it is not professional advice of any other kind.
The service is free. Sending a submission does not oblige you to buy anything, and it does not oblige us to reply. We aim to reply within about a week, but we do not promise a reply or a reply time, and we may decline any submission without giving a reason.
A reply may mention that Sam's Menswear can make or alter the garment. That is information, not a condition of the critique.
3. What you promise when you send a submission
By sending a submission you confirm that:
- you are 18 or older, or you are the parent or legal guardian of the person in the photo and you are sending it on their behalf;
- you are the person in the photo, or you have the permission of every person who can be identified in it to send it to us for the purposes in these terms;
- you took the photo or have the right to send it, and sending it does not infringe anyone’s copyright, privacy or other rights;
- the photo contains no nudity, nothing unlawful and nothing meant to harm or embarrass anyone; and
- the information you give us is accurate.
We may delete, without reply, any submission that does not meet these conditions.
4. How we use your submission (always)
We use your submission to read it, write Sam’s reply and send it to you. To do that:
- your submission is sent by email to Sam and to the people who help him run the website, using our email service provider;
- your name and email address (not your photo) are recorded in our customer relationship system, so that we can reply and keep a record of the enquiry;
- we may write to you once more about your submission. We will not add you to a mailing list without asking separately.
We do not sell your submission or your personal information, and we do not share them with anyone except the service providers who carry out these steps for us, who may store information outside Canada. We never use your photo to train software, and never share it with advertisers.
Photos are re-processed when you send them to remove hidden information such as the location a phone records.
Every photo is checked automatically before anyone sees it, by Google’s Gemini image-review service acting for us, to stop explicit, violent or unsuitable images and photos that are not of an outfit. Google receives a small copy of the photo for that check and handles it under its own terms, which may allow Google to keep it for a limited time and use it to improve its services. A photo the check refuses is not sent to anyone.
5. Publication (only if you choose it)
Publication is a separate choice from accepting these terms. If you choose “Private reply only”, nothing you send is published, anywhere, ever.
If you choose “Feature me, face hidden” or “Feature me as I am”, you grant Sam’s Menswear a non-exclusive, royalty-free, worldwide licence, for as long as your consent is not withdrawn under section 7, to:
- reproduce, crop, resize and draw on your photo (for example, marking the shoulder or the hem to illustrate Sam’s comments);
- publish it with your question (which we may shorten or edit for clarity without changing its meaning), the occasion, and Sam’s reply;
- identify you only by your first name or initials, never your full name, and never your email address; and
- publish all of this on customsuitandshirt.com, on Sam’s Menswear’s social media accounts and Google Business Profile, and in Sam’s Menswear’s own marketing.
If you choose “face hidden”, we will blur or crop out your face, and anything else that could readily identify you, before anything is published.
We decide whether and when to publish, and we are not obliged to publish any submission. No payment, credit or other compensation is due to you for publication.
A photo of anyone under 18 will never be published, whatever is chosen.
We will never publish anything mocking. Sam’s published comments are constructive by design.
6. Your own copyright
You keep the copyright in your photo. The licence in section 5 applies only if you choose publication, and ends as described in section 7.
7. Changing your mind
You can withdraw your consent to publication at any time, for any reason, by emailing hi@talkerstein.ca. We will remove your photo and the related text from customsuitandshirt.com and from our own social media accounts within 7 days of receiving your request, and we will not publish it again.
We cannot recall copies that other people have already saved, shared or printed, or material that third-party services keep in their own caches or archives, but we will not use it again ourselves.
You can also ask us to delete your whole submission. Withdrawing consent does not affect anything lawfully done before it.
8. How long we keep it
A submission that is not published is deleted within 12 months of our reply. A published submission is kept for as long as it is published and deleted within 12 months after it comes down. Your name and email address may be kept longer in our customer records as a record of the enquiry, and you can ask us to delete them.
9. Your privacy rights
You can ask to see the personal information we hold about you, to correct it, or to have it deleted, by emailing hi@talkerstein.ca. We handle personal information under Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). If you are not satisfied with how we handle a request, you can complain to the Office of the Privacy Commissioner of Canada.
10. Responsibility
Sam’s comments are an opinion given free of charge, and you decide what to do with them. To the extent the law allows, Sam’s Menswear is not liable for any loss arising from your use of a reply, or from any delay in replying or failure to reply. Nothing in these terms limits any right you have that cannot be limited by law.
11. Changes and governing law
We may update these terms. Each version is dated, and your submission is governed by the version you accepted when you sent it. These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
